Dear Sir Henry,
We have now consulted the Law Officers' Opinion
of the 27th September, 1899, to which you refer in
your letter No.53852/37 of the 11th October on the
subject of the status of leased territories in China.
We note that the Law Officers took a different view of
the effect of the Convention of 1898 from that taken by
the writers referred to in the memorandum by Fitzmaurice
of which I sent you a copy.
This, however, makes no practical difference,
because, as appears from that memorandum the authors
who take the view that in strict law these territories
remain the property of the leasing state agree that for
practical purposes the territory is treated during the
Sir Henry Moore, K.C.M.G.
